By accessing or using The Marimba Studio at themarimbastudio.co.za (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms apply to all visitors and users of the Service. Use of the Service constitutes full acceptance of these Terms and any additional guidelines or rules posted within the Service.
The Marimba Studio is a browser-based virtual marimba application. It provides interactive marimba instruments, guided learning, a song library, profile-backed progress, Rumble Points, recording tools, settings, and educational content.
The Service includes guest features and signed-in profile features. Not every feature is available to every user, device, browser, or account state.
Users may create a profile using email and password or a supported third-party login such as Google. You are responsible for keeping your login details secure and for activity that occurs under your account.
You agree to provide accurate account information and not to impersonate another person, create accounts for abuse, or interfere with other users. We may suspend, restrict, or remove accounts that misuse the Service, violate these Terms, or create operational or legal risk.
If you lose access to an account, available recovery options may depend on the login method used. Manual email/password accounts may use password reset where available. Third-party login recovery is handled by the relevant third-party provider.
Guest users may access limited free content and may use parts of the virtual marimba without signing in. Guest activity may not earn RP, may not sync across devices, and may not have access to profile-only tools such as saved recordings, MIDI, metronome, Rumble, Hover, TRG Style, or other studio tools.
Signed-in users may receive profile-backed features such as synced RP, owned unlocks, saved settings, song progress, recordings, and full songbook visibility. Some profile features may require RP, a profile, or another eligibility condition.
Rumble Points (RP) are a virtual in-app currency used inside The Marimba Studio. RP may be earned through eligible activity, granted as a bonus, or awarded through promotions.
• RP cannot be withdrawn, transferred, resold, exchanged for money, or redeemed for real-world goods.
• RP may be used only for eligible in-app unlocks or features.
• We may correct RP balances, reverse mistaken awards, remove abused RP, or adjust RP rules where necessary.
• RP is not a deposit, investment, stored-value account, or financial product.
RP balances and ownership records are attached to signed-in profiles where profile storage is enabled. Guest users may be unable to earn RP or keep RP across sessions.
Creating a profile is free. The Marimba Studio may also offer optional paid items such as profile subscriptions and Rumble Point (RP) support top-ups. Paid checkout is handled through PayFast or another payment provider shown at checkout.
Subscriptions may be offered monthly or yearly. Subscription benefits remain available while the subscription is active. If you cancel a subscription from the dashboard, benefits remain active until the end of the current paid billing period, unless otherwise required by law or stated at checkout.
RP top-ups are optional support purchases that grant virtual RP inside your profile. RP has no cash value and cannot be withdrawn, transferred, resold, redeemed for money, or exchanged outside The Marimba Studio. Songs are unlocked inside the app using RP; paying money for RP is not a direct sale of any third-party song or composition.
Payments are generally final once correctly processed and credited. Refunds, reversals, or corrections may be considered where required by law, where a duplicate or technical error occurred, or where The Marimba Studio determines a correction is appropriate. We may reverse mistaken, fraudulent, abused, or incorrectly credited RP or benefits.
The recording feature allows eligible users to record, save, play back, rename, download, or delete their own marimba performances. Users retain ownership of their original performances recorded through the Service.
By saving a recording through the Service, you grant The Marimba Studio the limited permission needed to store, process, display, and deliver that recording back to you as part of the Service. We do not claim ownership of your original recorded performance.
You are responsible for anything you record, download, publish, or share. If you record or share a performance based on a third-party song, you remain responsible for respecting the rights of the relevant copyright owners.
The Marimba Studio may include marimba arrangements, learning note sequences, backing tracks, demonstrations, or references to well-known songs. Unless clearly stated otherwise, The Marimba Studio does not claim ownership of third-party compositions, lyrics, original artist recordings, or underlying musical works.
All rights in third-party songs remain with their respective rights holders. If you are a rights holder and have a concern about a specific arrangement or reference, please contact marimba@therumblegod.co.za.
Alistair Dickerson, operating under the brand The Rumble God, is the sole creator, owner, and founder of The Marimba Studio and retains full intellectual property rights in the Service's original content and technology.
• original source code, scripts, software logic, and interface systems
• original visual design, layout, branding, and user interface elements
• original marimba audio samples and recordings produced for the Service
• The Marimba Studio name, logo, and brand identity
• original tutorials, learning materials, note sequences, and platform systems
• the Rumble Points system concept and implementation
You may use the Service for personal, educational, and lawful entertainment purposes. You may not copy, sell, redistribute, extract, scrape, clone, or commercially exploit the Service's original code, audio, design, branding, or assets without written permission.
RumbleWebsites (rumblewebsites.co.za) is the web design, development, and hosting brand operated by Alistair Dickerson. RumbleWebsites is responsible for technical development, deployment, hosting, and ongoing maintenance of The Marimba Studio.
All intellectual property rights in the Service's content and assets remain with Alistair Dickerson. RumbleWebsites retains recognition for its development resources, implementation methods, infrastructure, and technical work applied in building and operating the Service.
The Marimba Studio processes payments through our developer Rumble Websites, who is a verified PayFast merchant. All payment transactions are handled securely through PayFast's platform in accordance with their security standards.
The Marimba Studio and Rumble Websites will never ask you for your bank account details, login credentials, or passwords. If you receive any communication claiming to be from us and asking for such information, please treat it as fraudulent and do not respond.
All payment-related queries, disputes, and technical issues relating to transactions should be directed to PayFast (payfast.co.za) or to us at marimba@therumblegod.co.za.
Account data, profile storage, authentication, recordings, cookies, third-party services, and privacy rights are explained in the separate Privacy Policy.
By using profile, recording, or synced features, you acknowledge that some information must be processed to provide those features. Detailed privacy information, including POPIA-related rights and contact details, is handled in the Privacy Policy rather than repeated in these Terms.
You agree to use The Marimba Studio only for lawful, respectful, and intended purposes. You must not:
• exploit bugs, automation, bots, or unintended behaviour to inflate RP, bypass limits, or unlock restricted features
• attempt to bypass account, storage, RP, or security controls
• interfere with Supabase, hosting, email delivery, or other infrastructure used by the Service
• upload, save, share, or generate unlawful, abusive, infringing, misleading, or harmful content
• use the Service in a way that could damage, overload, disrupt, or negatively affect other users or the platform
We may restrict, suspend, remove, or refuse access where needed to protect users, the Service, legal compliance, or the creator's rights.
The Marimba Studio is actively developed and may change over time. Features, song availability, RP rules, recording limits, device support, and access rules may be added, changed, paused, or removed.
We aim to keep the Service useful and available, but we do not guarantee uninterrupted access, permanent storage, perfect compatibility, or that every feature will remain available forever. Maintenance, hosting issues, third-party outages, browser changes, or bugs may affect the Service.
These Terms may be updated at any time. Continued use of the Service after updated Terms are posted means you accept the updated Terms.
The Marimba Studio is provided "as is" and "as available". To the fullest extent permitted by law, no warranties are given that the Service will be uninterrupted, error-free, secure, compatible with every device, or suitable for any particular purpose.
Music learning content is provided for educational and entertainment purposes. It is not a substitute for formal music instruction, professional advice, or guaranteed learning outcomes.
To the fullest extent permitted by applicable law, Alistair Dickerson, The Rumble God, and RumbleWebsites shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.
This includes loss of RP, recordings, profile data, unlocks, revenue, opportunities, goodwill, device compatibility, or other financial or non-financial losses, except where liability cannot legally be excluded.
Payment-related liability, refunds, reversals, subscription access, and corrections are governed by these Terms, checkout information, and applicable law.
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the jurisdiction of the courts of the Republic of South Africa.
The Service is intended to operate in line with applicable South African legislation, including the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and, where personal information is processed, the Protection of Personal Information Act 4 of 2013 (POPIA).
