By accessing or using The Marimba Studio at themarimbastudio.co.za (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms apply to all visitors and users of the Service. Use of the Service constitutes full acceptance of these Terms and any additional guidelines or rules posted within the Service.
The Marimba Studio is a free, browser-based virtual marimba application. It provides users with interactive marimba instruments (Bass, Tenor, Alto, and Super Soprano), a guided learning system, a song library, a metronome, a recording feature, and educational tutorials.
The Service requires no account registration, subscription, or payment to access its core features. Certain optional in-app features may require the use of Rumble Points (RP), an in-app currency earned through normal gameplay (see Section 7).
Alistair Dickerson, trading as TRG Productions and operating under the brand The Rumble God, is the sole creator, owner, and founder of The Marimba Studio and retains full intellectual property rights over the following:
• All original source code, scripts, and software logic powering The Marimba Studio
• The visual design, layout, interface, and branding of the Service
• All original audio samples (Bass, Tenor, Alto, and Super Soprano marimba recordings) produced and recorded by Alistair Dickerson
• The "The Marimba Studio" name, logo, and associated brand identity
• All original song note sequences, tutorial content, and learning materials created for the Service
• The Rumble Points (RP) system concept and implementation
No part of the Service's original content, code, design, or audio samples may be reproduced, distributed, modified, or used commercially without express written permission from Alistair Dickerson.
RumbleWebsites (rumblewebsites.co.za) is the web design, development, and hosting brand operated by Alistair Dickerson. RumbleWebsites is solely responsible for the technical development, deployment, hosting infrastructure, and ongoing maintenance of The Marimba Studio.
RumbleWebsites retains recognition and credit for all development resources, tooling, hosting infrastructure, and technical implementation used to build and operate the Service. The Marimba Studio is developed and powered by RumbleWebsites.
The Marimba Studio's song library includes marimba arrangements of well-known songs ("Covers"). The following must be clearly understood by all users:
The Marimba Studio does not claim any ownership, copyright, or intellectual property rights over any cover songs, their underlying compositions, lyrics, or the original recordings by their respective artists.
All cover arrangements present within the Service have been independently recorded and arranged by Alistair Dickerson on marimba. They do not use, sample, or incorporate any audio material from original artists' recordings, productions, or master recordings.
These cover arrangements are provided solely for educational and entertainment purposes. They do not generate any financial gain, revenue, or commercial benefit for Alistair Dickerson, TRG Productions, RumbleWebsites, or The Marimba Studio.
Copyright and intellectual property rights to the underlying compositions of all cover songs remain entirely with their respective original composers, songwriters, and rights holders.
If you are a rights holder and have a concern regarding a specific arrangement featured in the Service, please contact us at marimba@therumblegod.co.za and we will address your concern promptly.
Rumble Points (RP) are a virtual in-app currency earned by using The Marimba Studio. RP can be used to unlock optional features within the Service.
• RP is stored locally in your browser using localStorage and is tied to the specific device and browser you are using.
• RP balances may be reset if you clear your browser data. The Marimba Studio accepts no liability for lost RP due to browser data clearance.
• RP cannot be purchased with real money. It is earned exclusively through normal use of the Service.
The Marimba Studio provides a recording feature that allows users to record and download their own marimba performances. Users retain full ownership of their own original recordings made using the Service.
Recordings are saved locally on your device via localStorage and are not transmitted to, stored on, or accessible by any server, third party, or the Service operators. The Marimba Studio makes no claim of ownership over any user-generated recording.
Users are solely responsible for ensuring that any recording they make, share, or publish does not infringe upon third-party rights, including any cover songs they may have played during recording.
The Marimba Studio is designed with privacy as a priority. The Service does not collect, transmit, store, or process any personal data on external servers.
• Your Rumble Points balance and unlocked features
• Your saved recordings (audio data)
• Your settings and preferences (play mode, marimba type, tempo, etc.)
• Loading screen cooldown timestamps
• Tutorial completion status
All of the above is stored exclusively in your browser's localStorage. No data leaves your device. No accounts, no sign-ups, no tracking, no cookies, no analytics.
By using the Service you acknowledge and accept that all data is stored locally and that clearing your browser's site data will permanently erase your Rumble Points, recordings, and settings.
You agree to use The Marimba Studio only for lawful purposes. You must not:
• Exploit bugs, glitches, or unintended behaviours to gain unfair advantages within the Service (e.g., artificially inflating Rumble Points)
• Attempt to circumvent, disable, or tamper with any feature locks, RP systems, or security measures
• Reproduce or redistribute the Service's original assets, audio samples, or code without express written permission
• Use the Service in any way that could harm, disrupt, or negatively affect other users or the Service itself
Alistair Dickerson reserves the right to update the Service or restrict access to address misuse, without notice.
The Marimba Studio is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Alistair Dickerson, TRG Productions, and RumbleWebsites do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Your use of the Service is entirely at your own risk.
The Service is provided free of charge, and while every effort is made to keep it accurate and functional, no guarantee is made as to its completeness, reliability, or suitability for any particular purpose.
To the fullest extent permitted by applicable law, Alistair Dickerson, TRG Productions, and RumbleWebsites shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Service.
This includes, without limitation, loss of data (including Rumble Points or saved recordings), loss of revenue, or any other financial or non-financial losses, even if Alistair Dickerson has been advised of the possibility of such damages.
Since the Service is provided free of charge and no real-world monetary transactions occur within it, your sole remedy for dissatisfaction with the Service is to discontinue use.
Alistair Dickerson reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes are published constitutes your acceptance of the revised Terms.
It is your responsibility to review these Terms periodically. We will note significant changes in the Service's Update Log.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.
Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
The Service operates in compliance with applicable South African legislation, including but not limited to the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Protection of Personal Information Act 4 of 2013 (POPIA).
